Murder vs. Capital Murder Charges in Texas

Texas Penal Code, Chapter 19. Criminal Homicide defines murder and capital murder, as well as two other types of homicide: manslaughter and criminally negligent homicide.

There are a few key differences between murder and capital murder:

• Murder involves:
  • Intentionally or knowingly causing the death of another person;
  • Causing the death of another even if the intent was to cause serious bodily injury;
  • Causing the death of another as a result of an act that was clearly dangerous and potentially deadly; or
  • Causing the death of another during the commission or attempt to commit a felony, or flight thereof.
• Capital murder involves committing murder and:
  • The victim was a fireman or peace officer;
  • The victim was under the age of 10;
  • The act was committed during the commission of kidnapping, robbery, arson, robbery, burglary, terroristic threat, obstruction, or retaliation;
  • The act was committed during an escape or attempt to escape from jail or prison;
  • The act was committed by an incarcerated person, and the victim was an employee of the penal institution;
  • The act was committed while serving a life sentence or 99-year term;
  • More than one victim was murdered during the same act; or
  • More than one victim was murdered in different acts but under a similar course of conduct or scheme.
